Rent My Kit.

"Owner" means Joshua Chan, trading as Joshua Chan Media (ABN 41 373 251 276).

"Hirer" means the person or entity hiring the Equipment, as named on the booking.

"Equipment" means the item(s) listed on the booking confirmation, together with all included accessories.

"Rental Period" means the agreed period from handover to return, as stated on the booking confirmation.

"Agreement" means these Terms & Conditions together with the booking confirmation.

The full rental fee for the first day of the Rental Period, together with the full Security Deposit, must be paid in cleared funds before the Equipment is released to the Hirer. Equipment will not be released without both payments having cleared.

The Security Deposit is fully refundable, subject to the Equipment being returned in the same condition as provided (fair wear and tear excepted), on time, and complete with all accessories.

The Hirer must present valid government-issued photo identification at handover, matching the name on the booking. The Owner will retain a copy or record of this identification for the duration of the Rental Period.

The Rental Period, including exact start and end date/time, will be confirmed in writing (including by message) prior to handover.

Equipment not returned by the agreed end time will incur a late fee of 150% of the standard daily rate for each day or part-day overdue, in addition to the Hirer remaining fully responsible for the Equipment until it is returned.

If Equipment is more than 7 days overdue without prior arrangement with the Owner, it will be treated as lost, and the Hirer will be liable for its full replacement cost as set out in Section 6, less any amounts already paid.

The Equipment will be inspected and photographed by the Owner immediately prior to handover, wherever practical in the presence of the Hirer. These photographs form the baseline record of the Equipment's condition at the start of the Rental Period.

The Hirer should raise any pre-existing damage or missing items at this time. Anything not raised at handover will be treated as not present at the start of the Rental Period.

The Equipment will be inspected and photographed by the Owner immediately upon return, and compared against the pre-rental record.

Where practical, the Hirer will be given the opportunity to be present for this inspection. Where the Hirer is not present or does not respond within 48 hours of being offered the opportunity, the Owner's assessment based on the photographic evidence will stand.

"Damage" includes, without limitation, any of the following, beyond fair wear and tear consistent with normal, careful use:

• Physical damage including drops, impacts, cracks, dents, or scratches
• Water or liquid damage, including rain exposure beyond the manufacturer's rated tolerance, submersion, spills, or condensation damage
• Ingress of sand, dust, dirt, or other fine particles
• Exposure to salt air, salt water, or other corrosive conditions
• Exposure to heat, cold, or humidity outside the manufacturer's stated operating range
• Battery damage, including swelling, puncture, over-discharge, or damage from an incompatible charger
• Damage arising from unauthorised repair, modification, or disassembly
• Damage arising from use of incompatible or non-genuine accessories, batteries, or media cards
• Loss of, or damage to, any accessory, cable, memory card, case, propeller, filter, or other included component
• Cosmetic damage beyond fair wear (fair wear meaning minor surface marks only, with no effect on function or resale value)
• Corruption or damage arising from unauthorised firmware or software modification
• For drones specifically: crash or collision damage of any kind (including with people, animals, structures, vehicles, or vegetation); damage from flight in conditions outside the manufacturer's recommended operating conditions (including excessive wind or precipitation); damage arising from loss of control-link signal; and damage arising from operation in an area subject to GPS interference or restriction
• Loss, theft, or confiscation of the Equipment by any third party or authority, including as a result of unlawful operation by the Hirer

The Hirer is liable for the reasonable cost of repair. Where repair is not possible or practical, or the cost of repair would exceed the Equipment's replacement value, the Hirer is instead liable for the reasonable replacement cost, as assessed by the Owner or a qualified independent repairer.

The Security Deposit will be applied first towards this cost. Where the cost exceeds the Deposit, the Hirer remains liable for the balance. Where the cost is less than the Deposit, the remaining balance will be refunded to the Hirer within 7 days.

Where damage prevents the Owner from hiring the Equipment to other customers, the Hirer is additionally liable for the Owner's reasonable loss of hire income for the period the Equipment is unavailable, calculated at the Equipment's standard daily rental rate.

The Owner will provide the Hirer with photographic evidence and, where a repair or replacement is required, supporting quotes or invoices, before finalising any charge against the Deposit or otherwise.

This section applies in addition to Sections 6 and 7 wherever the Equipment includes a drone/RPA (remotely piloted aircraft).

The Hirer confirms they will operate the Equipment in full compliance with all applicable Civil Aviation Safety Authority (CASA) rules, including standard operating conditions, controlled and restricted airspace requirements, and applicable privacy laws.

The Hirer confirms they hold, and will maintain for the duration of the Rental Period, any CASA accreditation, registration, or licence required for their intended use, including a valid Aviation Reference Number (ARN) where applicable.

Where the Equipment will be used for any commercial purpose, the Hirer must provide the Owner with a copy of their relevant CASA accreditation, RePL, and/or ReOC details (as applicable to their operation) before the Equipment is released. The Owner reserves the right to refuse or cancel a booking where this is not provided, or where the Owner reasonably believes the Hirer is not appropriately qualified for their stated use.

The Hirer assumes full and sole responsibility for the safe, lawful, and compliant operation of the Equipment for the entire Rental Period, regardless of who is physically operating it.

The Hirer must not, under any circumstances:

• Operate in controlled or restricted airspace without the required authorisation
• Operate within any exclusion zone, including near airports, aerodromes, emergency service operations, or major public events, without authorisation
• Operate over people or crowds without the required authorisation
• Operate at night without the required authorisation
• Operate beyond visual line of sight without the required authorisation
• Operate while under the influence of alcohol or any impairing substance
• Operate in a manner that breaches any CASA regulation, other applicable law, or the manufacturer's safety guidelines

The Hirer must not permit any person not named on the booking to operate the Equipment, and must not sub-hire, sub-lend, or otherwise pass on the Equipment to a third party.

The Hirer is strongly encouraged to hold their own public liability insurance covering their use of the Equipment. For any commercial use, the Owner may require a Certificate of Currency evidencing this cover before the Equipment is released.

The Owner's own insurance (where held) covers the Owner's own operation of equipment and does not extend to the Hirer's use of hired Equipment.

The Hirer indemnifies and holds harmless the Owner against any claim, loss, damage, cost, fine, or liability (including reasonable legal costs) arising from the Hirer's use, misuse, or operation of the Equipment during the Rental Period, except to the extent directly caused by the Owner's own negligence.

• Use of the Equipment outside Australia without the Owner's prior written consent
• Use of the Equipment for any unlawful purpose
• Use of the Equipment in hazardous environments (including extreme weather, near water without appropriate protection, or industrial/hazardous sites) without the Owner's prior written consent

Cancellations made more than 48 hours before the start of the Rental Period will be refunded in full. Cancellations made within 48 hours may forfeit the first day's rental fee. The Security Deposit is always refunded in full for a cancellation, as it is never drawn on until Equipment is released.

To the maximum extent permitted by law, the Owner is not liable for any indirect or consequential loss (including loss of income, business, or opportunity) arising from the Hirer's use of, or inability to use, the Equipment.

Nothing in this Agreement excludes, restricts, or modifies any guarantee, right, or remedy available to the Hirer under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, restricted, or modified.

This Agreement is governed by the laws of New South Wales, Australia.

If any provision of this Agreement is found to be unenforceable, that provision will be read down to the minimum extent necessary, and the remainder of the Agreement will continue in full force.

This Agreement, together with the booking confirmation, constitutes the entire agreement between the parties for the Rental Period.
